Know your privacy rights
The TIMBY project is designed to help you report, verify, compile and share your stories.
This policy is intended to acknowledge your rights while preserving our ability to provide high quality service to the broadest audience possible. Accordingly, this is a “living document,” and may change from time to time. By using the software, service, or any applications (including the TIMBY website and mobile applications), you agree to be bound by the latest version, which can be found at https://timby.org/privacy-policy/. We welcome your comments, and you are welcome to direct any feedback regarding these terms to info@timby.org. Please put “Privacy Policy” in the subject heading.
By accessing or using the TIMBY website, service, or any applications (including mobile applications) made available by TIMBY Productions Inc. or any derivative, (collectively, “the technology”), you agree to be bound by this Privacy Policy as well as our End User License Agreement, found here: https://timby.org/eula/. These documents affect your legal rights and obligations. If you do not agree to this policy, do not access or use the technology.
Information collected: We may collect the personal information which you provide, including your name, account information, e-mail address, and other contact information as part of the sign-up process. You may also use the system anonymously through an anonymous login. Information you submit using the technology is not confidential by nature, as you are sharing it with your platform. You should exercise caution when deciding what to disclose and do so at your own risk. By using the technology, you agree to hold harmless TIMBY Productions Inc. for any claim rooted in “moral rights,” including rights of publicity and privacy.
Use Your Information: i) Personal Information. TIMBY uses your Personal information in a variety of ways, including: · to register you to the TIMBY platform and give you access to the various parts of the TIMBY system; to enable you to reset your password; to send you informational emails about new critical and feature updates to the TIMBY system (bug fixes etc.); · to contact you in regards to the administration of your account, services, features or functions you have registered to use, or any content you have posted that contradict our EULA; to answer your questions or requests; · to improve the technology and our services for our own business purposes; · to create your experience with the technology; · to save your account or other Personal Information for easy login; to maintain and administer the technology; · to research, develop, manage, protect and improve those services and the technology; · for any other purpose disclosed to you at the time of your registration with the technology. TIMBY may ask for the right to post your logo and a brief description of your project on the TIMBY website (under https://timby.org/ or supporting websites).
Your Personal Information and any data (that is not public) will not be disclosed intentionally by the TIMBY system or personnel. Any data that you make public or share privately or publicly from your TIMBY system (as described in the TIMBY manual), is not covered by TIMBY’s privacy-policy because it is part of the public record. Personal Information may be transferred to third parties only for the purposes of supporting and enhancing your use of the technology and its features, including without limitation: tracking bugs and crashes in the technology; providing customer service; tracking shares and spread of your TIMBY work in the analytics we provide to users on their systems; and otherwise supporting your use of the technology. TIMBY reserves the right to contact you regarding matters relevant to the underlying service provided and/or the information collected.
TIMBY may permit certain trusted third parties (Google Analytics, for example) to access your Personal Information in order to track usage, analyze data such as the source address that a page request is coming from, IP addresses or domain names, the date and time of the page request, the referring Web technology (if any) and other parameters in the URL. This is collected in order to better understand our Web technology usage, and enhance the performance of services to maintain and operate the Technology and certain features on the Technology. We may use third parties to host the Technology; operate various features available on the Technology; send emails; analyse data; provide search results and links and assist in fulfilling your orders (for example we sync video and audio to private Vimeo and Soundcloud channels so that users in low network environments can stream their content more easily). We may transfer Personal Information as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganisation, stock sale or other change in control.
WE ARE NOT LIABLE OR RESPONSIBLE FOR THE PERSONALLY IDENTIFIABLE OR OTHER INFORMATION YOU CHOOSE TO SUBMIT IN RATINGS, COMMENTS, BLOGS, ANY OTHER TEXT FORMS, AND FORUMS THAT ARE PUBLICLY ACCESSIBLE AREA OF THE TECHNOLOGY.
Third Party Websites: We cannot guarantee your privacy on any website not controlled by TIMBY Productions Inc., including those you arrive at by visiting an advertisement or link originating on this site. We are not responsible for the terms or policies of sites we do not control.
Site use: The technology may allow you to access, or provide feedback relating to user- provided content.
Anonymous information: We may collect IP addresses and other server-generated information for demographic purposes for your administrator use, including the analytics page and the stream function for security purposes.
Cookies: Cookies are information generated by our servers and stored on your personal computer, which improve your experience by saving your preferences and other information related to your individual use of the technology. We may use cookies from time to time- you can disable this functionality in your web browser, but doing so may render some or all of the site inoperable.
Location: The information we gather is stored and processed within Europe Canada and the United States. By using the technology, you agree to such storage and processing, regardless of the where you are located.
Government Action: We reserve the absolute right to release any and all information at our sole discretion when requested in the course of any legal action, court order, law enforcement, statutory or other governmental authority or proceeding or when we believe in good faith that disclosing this information is otherwise necessary, including but not limited to instances where doing so is required to prevent or mitigate injury or interference with the right of ourselves, other users, or other third parties who could be harmed by a failure to so disclose. We may additionally disclose for any reason information we believe to be false, fraudulent, or violative of our terms of service.
Correcting or Deactivating your account: You may correct inaccuracies in your user information or deactivate your account and remove the ability of other users or the public from seeing your information by emailing info@timby.org and write in the subject “deactivate.” Such requests may take up to 8 weeks for processing.
Data Portability: You may request to obtain a copy of your user information or request its transmission to another data controller by emailing info@timby.org and writing in the subject “Download my Data” or “transmit my data". Such requests may take up to 8 weeks for processing. As a site administrator, you may also obtain a copy of data on your site through the administrator page.
Deleting your information: You may request to have your user information deleted by emailing info@timby.org and writing in the subject “Delete”. Such requests may take up to 8 weeks for processing.
Dispute: Any dispute of this policy shall be construed in accordance with the laws of the Province of Quebec and of Canada applicable therein.
Notification of Changes TIMBY reserves the right to change this Privacy Policy from time to time at its sole discretion. If at some point in the future, there is a change to our Privacy Policy, unless we obtain your express consent, such change will only apply to information collected after the revised Privacy Policy took effect. Your continued use of the Site indicates your assent to the Privacy Policy as posted.
